Why Probate?
A probate procedure is how you get real estate, stocks, and
bank accounts in your name alone transferred to your heirs;
The Court will appoint the executor you named in your Will
to control and marshal your real estate, bank accounts and
assets so the banks and investment companies can release your
assets and rely on the executor's signature. Then your executor's
job is to pay claims, protect your assets, and distribute
them to your beneficiaries that you named in your Will.
Other facts regarding Probate:
- Bank and investment accounts set up as Transfer on Death
or POD may avoid Probate
- If all assets just in your name are less than $75,000
a simple Summary may be available;
- If personal property is under $50,000 for Non Florida
